An Atascadero girl died Tuesday after being struck by a car while trick-or-treating on Halloween night.
According to a San Luis Obispo Police press release, Kimberly Macias, 8, was crossing South Street in San Luis Obispo when she was hit by an Acura Legend driven by liberal studies senior Annie Tong-Try. Police determined that neither alcohol nor drugs were factors in the accident, and Tong-Try was driving within the 45 mph speed limit.
At 8:19 p.m. on Monday, Macias was out trick-or-treating with her friends and family dressed in a black costume. According to police, Tong-Try swerved to avoid hitting several other children, but struck Macias who had apparently fallen behind the group.
Macias was transported to French Hospital where she was listed in critical condition, and was then flown to Cottage Hospital in Santa Barbara where she died at 7:25 p.m. on Tuesday, Nov. 1.
There are no crosswalks or streetlights at the South Street and Kings Court intersection, and since Macias was wearing a black costume, darkness was likely a contributing factor.
Police are investigating the accident to determine whether Tong-Try should face charges.
