Nutrition senior and former Delta Sigma Phi president Gear McMillan pleaded no contest this morning to felony possession for sale of marijuana, according to a press release from the San Luis Obispo District Attorney’s Office.
According to the San Luis Obispo Tribune, in exchange for the no contest plea, prosecutors dismissed a felony charge of possessing a controlled substance – unidentified prescription pills – for sale.
McMillan will return to court for sentencing on April 17 and will be sentenced to no more than one year in county jail, which was one of the terms of his probation grant.
Additionally, McMillan will have to register as a drug offender and could be fined between $300 and $10,000, the San Luis Obispo Tribune reports.
McMillan’s arrest came while police were investigating the armed robbery attempt at the Delta Sigma Phi fraternity house on Aug. 10., in which five Cal Poly football players were arrested. According to San Luis Obispo Police Department press release from September, investigators were told that part of the motive for the attempted robbery may have been to take cash and illegal drugs from the fraternity house.
The case of the five football players is still pending.
