There will be no investigation into the reported sexual assault on a female student that occurred Sunday morning in Muir Residence Hall, University Police Department Chief George Hughes said on Tuesday.
“The survivor (of the assault) has not reported it to us,” Hughes said. “If the survivor does not want to report it, there is nothing for us to investigate. … We cannot pursue an investigation.”
The report of the assault — called a “forcible sex act” in the safety alert sent out to campus on Monday — was sent to UPD later that afternoon by Cal Poly’s sexual assault and violence prevention program Safer. Safer is required by the Clery Act to report any sexual assaults occurring on campus to UPD, which in turn is required to issue a campus safety alert.
From there, though, it is up to the individual who was assaulted to decide whether they wish to pursue legal action. In this case, the student did not wish to make a report, Hughes said.
This is the fourth sexual assault involving Cal Poly students this year, and the second to take place on the Cal Poly campus.
